Study Area and Scope of Work
A single County-maintained road on the Pueblo of Tesuque, 72-I (Old Coach Road), is addressed in the Settle Agreement ROW transfer (see Vicinity Map to the right, overview Topographic Map, and detailed Land Use Map. The ROW to be transferred is an existing CMR, which has been surveyed by the County. Where property boundaries exceeded the ROW width adjacent to the roadway, resource surveys were conducted to the boundary line. The ROW and boundary lines were identified by a civil land survey conducted by the County for the relevant Settlement Agreement roads.
The Proposed Action requires the County to apply for the ROW for CMR 72-I from the BIA for an initial term of 99 years with an automatic renewal of 99 years. The County will compensate the Pueblo for the ROW granted by the Secretary of the Interior. This is a wholly administrative action. No improvements or alterations are currently proposed. No earth or vegetation disturbance would occur under the Proposed Action. Any disruptions in the ROW for emergency access or repair will be subject to the County’s right of eminent domain, are not part of the Proposed Action, and will be the complete responsibility of the County.
